Bill Cosby On Trial On Three Aggravated Sexual Assault Charges

Didn’t we all have a feeling this would happen? The high-profile trial/circus show accusing Bill Cosby of aggravated indecent assault ended in a mistrial Saturday after a Pennsylvania jury was unable to come to a unanimous decision. Prosecutors immediately announced they will retry the case.

About an hour into the sixth day of deliberations, Judge Steven O’Neill declared the jury of seven men and five woman hopelessly deadlocked in a legal battle closely watched by the public as well as dozens of women who have accused Cosby of similar misconduct in the past. He faced three charges of aggravated indecent assault.

Outside court, Cosby did not speak, but a member of his press team read a scathing statement from his wife, Camille, blasting the prosecution, judge and media:

“How do I describe the District Attorney? Heinously and explosively ambitious. How do I describe the judge? Overtly and arrogantly collaborating with the District Attorney. How do I describe the counsels for the accusers? Totally unethical. How do I describe many, but not all, general media? Blatantly vicious entities that continually disseminated intentional omissions of truths for the primary purpose of greedily selling sensationalism at the expense of a human life.”

The case was almost 100% based on the credibility of Ms. Constand, a former Temple University employee. She testified that the assault occurred in a visit to the home of Mr. Cosby, who was a Temple trustee, when she was 30 and he was 66. She said that Mr. Cosby gave her pills that he said were herbal, but that left her immobile and drifting in and out of consciousness. He has said that he only gave her Benadryl.

“I was jolted awake and I felt Mr. Cosby’s hand groping my breasts under my shirt,” she testified last week. “I also felt his hand inside my vagina moving in and out, and I felt him take my hand and place it on his penis and move it back and forth.”

The “Factses?”

Mr. Cosby was charged with three counts of aggravated indecent assault  penetration with lack of consent, penetration while unconscious, and penetration after administering an intoxicant without the subject’s knowledge. Each is a felony punishable by up to 10 years in state prison…..wow.

The jury of 12 was composed of six white men, four white women, one black woman and one black man. They had reported being deadlocked on Thursday but then had resumed deliberations at the request of the judge. As it turned out, the deliberations ended up taking longer than the presentation of evidence had.
